GENERAL TERMS AND CONDITIONS FOR USING THE DINNER IN THE SKY® ONLINE ORDERING SYSTEM

DINNER IN THE SKY® online booking system terms and conditions.

1. Visitors and users of the Dinner in the Sky® online ordering system (hereinafter referred to as the online shop) agree to the following terms and conditions (hereinafter referred to as the terms and conditions):

2. “Dinner in The Sky®” online reservation system is operated by Skyworld International OÜ (hereinafter referred to as “Skyworld International”), registered at 14700221, registered in Estonia, Harju County, Harku Municipality, Tiskre Village, Puisniidu Road 2-5, 76916, e-mail invoice@dinnerinthesky.ee.

3. Skyworld International is not the event organiser.
The online booking system sells tickets in the name of, on behalf of and for the account of the organiser Skyworld Entertainment OÜ (hereinafter referred to as the ‘organiser’); the organiser’s registration number is: 12960432, registered office: Kopli 69C, Tallinn. Skyworld International has no right to set or change ticket prices or terms and conditions of sale, including the allocation of seats at any event; Skyworld International will not redeem or replace tickets or refund lost, stolen, damaged, etc. c. the value of the tickets. Skyworld International shall not be liable for any loss or damage in connection with any Event, including the value of any items lost in connection with any Event. The rights and obligations arising from tickets are determined and communicated by the organiser of the relevant event and Skyworld International is in no way responsible for the content, modification, exercise, etc. of these rights and obligations. c..

4. Skyworld International does not represent the event organisers, event performers or any other person responsible for the organisation, content, related information or promotion of such event. These are the responsibility of the person organising the event, whose details are listed on the Dinner in the Sky® online booking system website and whose contact details are on the ticket. Any complaints regarding the organisation of the event should be addressed directly to the event organiser.

5. The ticket(s) will be collected from the online booking system once payment for the ticket(s) has been made following confirmation of the order.

6. Keep your tickets in a safe and secure place. Direct sunlight and heat can damage your ticket.

7. Skyworld International shall have no obligation to refund or reimburse tickets in the event of cancellation, transfer or change of venue. Unless otherwise stated, redemption or refund shall be made by the event organiser.

8. Any use of the Dinner in the Sky® online booking system website, its content and the data contained therein for illegal activities or for the sale or resale of tickets, for advertising or commercial purposes or for any other profit-making purpose, including ticket brokering, is prohibited without the prior written consent of Skyworld International. Skyworld International shall be entitled to claim from any purchaser who is in breach of the above condition a penalty of up to EUR 100 000 per breach of contract.

9. In the event of a breach of the terms and conditions of use of the online booking system, Skyworld International shall be entitled to unilaterally revoke the right to use the online shop and/or ticket purchase transactions of the person who has committed such breach.

10. By taking any action on the Online Booking System website, the Buyer confirms that:

1. the person is at least 18 years old and has all the direct and indirect legal rights to use the online booking system;

(2) it is a legal person whose representative has all and any rights to use the online LTS on behalf of that legal person and has all the obligations of that legal person;

3. the person concerned complies with all the terms and conditions of use of the online ordering system.

11. Neither Skyworld International nor the Promoter shall be under any obligation to verify that the person issuing the Ticket is the person who purchased the Ticket and neither shall be liable for any loss arising out of the foregoing. If a buyer presents a printed ticket on entry to an event, the buyer is deemed to have entered the event if the buyer first provides the organiser with a printed copy of the ticket for scanning.

Skyworld International reserves the right to change the terms and conditions of use of the online booking system by publishing the relevant information/notice on the dinnerinthesky.lv website in advance. The relevant changes will take effect once they are published on the online shop’s website.

13. Any claims regarding the organisation, content, quality, advertising, etc. of this website. should be addressed to the event organiser.

14.Any dispute arising in connection with the Online Booking System Website shall be settled by the Harju County Court in accordance with these Terms and Conditions and the laws of the Republic of Estonia.

15. Skyworld International cannot view card details related to transactions made by customers. To complete the transaction, the customer will be redirected to a secure banking card centre environment. During the payment process, the card issuer enters the card data into the Card Centre server database and all transaction-related data is also entered into the Card Centre server. Skyworld International is not responsible for the accuracy or inaccuracy of the map data. To prevent counterfeiting, Skyworld International can monitor the IP addresses of buyers to detect the use of different cards from the same IP address or on behalf of different recipients. Skyworld International will inform the bank if fraud is suspected.

16.In case of suspected card fraud, the Bank has the right to suspend the transaction pending investigation or cancel the entire transaction. If the Bank notifies Skyworld International of a transaction investigation, Skyworld International may not issue the goods until the investigation is completed.

17.When card details are requested, the MasterCard security code and the Visa system verification code shall be used.

18 The Terms and Conditions shall come into force upon acceptance by the Buyer and shall remain in force for the duration of the legal relationship between the Buyer and Skyworld International; the relevant Terms and Conditions shall govern the entire relationship. The Buyer has the right to withdraw from these terms and conditions within 14 days of acceptance.

19.The Buyer agrees to receive notification from Skyworld International to the email address provided by the Buyer.

20. In the event of cancellation, Skyworld International is obliged to refund the ticket price less service charges and commission. In the event of cancellation, Skyworld International shall be entitled to deduct from the refund the commission indicated on the ticket.

21.If the payment was made by bank card, the only way to cancel the transaction is to send a notification to the bank with the transaction details. The application must also state the reason for cancellation. No other channels can be used to return the payment. The cardholder will only be informed in writing of the cancellation if the goods have been returned and the cancellation is based on a written request from the buyer.

22.In the event of a refund of the fare paid for a ticket, the amount refunded shall be reduced by administration, delivery and ancillary costs.

23.All cancellation and change requests must be submitted one week before the event.
24. The event will be affected by winds of more than 15 metres per second and thunderstorms. In case of no-show, food will be served downstairs in the lounge and all guests will receive a Dinner in the Sky gift voucher of the same value as in case of no-show.

25.In the event of a weather-related interruption of lift operation, guests who have spent less than half the time in the lift will be compensated with a gift voucher for 50% of the value of the interrupted lift operation.
